Montana Cannabis Legal Status: Medical and Recreational Sales are Legal
There is one primary governing body of cannabis construction and operation in Montana, the Montana Department of Public Health and Human Services (DPHHS). is responsible for licensing medical and recreational marijuana providers and dispensaries.
Building Code
Building a dispensary in Montana is subject to both local municipal building inspections, which follows the universal building code and also final operation inspections by the Montana Department of Public Health and Human Services, DPHHS.
The final Montana cannabis building inspections are done through the local municipal building department, but operation approval also must pass inspection by the DPHHS Local building inspectors will inspect that all building code requirements and standard life safety items have been satisfactorily met in the cannabis dispensary and the DPHHS will inspect that the dispensary-specific requirements have been met such as proper surveillance, online monitoring, and required vault construction and cannabis storage among other items.
Security Requirements
Montana code leaves much of the security details and specifications up to the applicant and cannabis builder. The code only states that commercial grade locks must be installed on every external door and gate and that the licensee must have a written security plan maintained on site.
News
During the November 2020 election 57% of Montana voters approved a measure and constitutional amendment to make adult-use marijuana legal in the state. Sales are expected to start in January 2022. The state’s adult-use cannabis market is projected to generate between $217 and $260 million in sales per year by 2026.
Zoning Law
Montana dispensaries may not be located within a zone of a city, town, or county where activity related to medical marijuana use is prohibited. Additionally, dispensaries may not be located within 500 feet of any church, synagogue, or other place of worship, or of a school or post-secondary school.
